SUBJECT : REGISTRATION, ACCREDITATION AND ISSUANCE OF CERTIFICATE OF COMPLIANCE (COC) AND CERTIFICATE OF GOOD STANDING (CGS) FOR COOPERATIVES ENGAGED IN TRANSPORT SERVICES

1.0 BACKGROUND.

Cooperative Development Authority (CDA) is a government agency created under Republic Act No. 6939 with principal office address at 827 Aurora Boulevard, Brgy. Immaculate Concepcion, Cubao, Quezon City, tasked to regulate and develop cooperatives, and hereinafter referred to as “CDA”;

Office of Transportation Cooperatives (OTC) is an attached agency of the Department of Transportation (DOTr), created and operating pursuant to Executive Order No. 898 dated 28 May 1983 with the mandated functions of promoting, organizing, accrediting, supervising and developing transport service cooperatives, and hereinafter referred to as “OTC”;

Republic Act No. 9520, otherwise known as the Philippine Cooperative Code of 2008, and its Revised Implementing Rules and Regulations, specifically recognizes the shared responsibilities between the CDA and the OTC in attaining the noble objectives of the Transportation Cooperative Program;

2.0 PURPOSES

This Joint Memorandum Circular is issued as a guide for CDA and OTC to harmonize their efforts, resources and other significant programs/activities to effectively respond to the needs, demands and other requirements on organization, registration, accreditation and COC/CGS issuances to transport service cooperatives.

3.0. GENERAL GUIDELINES

A. No transport service cooperative (TSC) shall be registered with CDA without the favorable endorsement by OTC as provided under Section 6, Item No. 10, Rule V of the Revised Rules and Regulations of the Special Provisions of RA 9520;

B. CDA and OTC shall conduct the Pre-Registration Seminar (PRS) and Cooperative Education and Transport Operations Seminar (CETOS) to TSC-applicants, respectively as provided under Section 6, Item Nos. 4 and 5, Rule V of the Revised Rules and Regulations of the Special Provisions of RA 9520;

C. TSCs shall secure their respective Certificate of Compliance from CDA after submission of the necessary requirements thereto;

D. No Certificate of Good Standing (CGS) shall be issued by the OTC without the Certificate of Compliance issued by the CDA; and

E. The CDA and the OTC shall collaborate in the social preparation, registration, conduct of mandatory trainings, and other developmental initiatives in the industry consolidation;

3.0 IMPLEMENTING RULES AND REGULATIONS

Within thirty (30) days from the effectivity of this JMC, the CDA and OTC shall issue the Implementing Rules and Regulations for the effective implementation of this Circular.

4.0 REPEALING CLAUSE

All orders or issuances inconsistent to the provisions of this JMC are hereby repealed or modified accordingly.

5.0 EFFECTIVITY

This JMC shall take effect fifteen (15) days after publication in the Office of National Administrative Register (ONAR).
